Further to James Dick Construction Limited’s new application for re-zoning of the proposed Hidden Quarry site, the second OMB Hearing process was launched with a Pre-Hearing Conference on November 2, 2017. At this Conference the date for the next Pre-Hearing was scheduled for April 5, 2018.
In April 2017, the Grand River Conservation Authority had requested more information and studies from JDCL, and had recommended deferral of decisions by the Ministry of Natural Resources and Forestry, Wellington County and Guelph Eramosa Township until GRCA had assessed the JDCL responses. The next Pre-Hearing date was set so that all Parties would have time to study and assess this pending GRCA Report.
The OMB has scheduled a first Pre-Hearing Conference on the Hidden Quarry Application by James Dick Construction Limited for Thursday, November 2, 2017 at 10 am at the offices of Guelph Eramosa Township, 8348 Wellington Road 124, Rockwood, ON N0B 2K0.

2016 Hearing Postponed: Just a year ago we were preparing for the OMB Hearing on September 27 on the Hidden Quarry application. That Hearing was postponed indefinitely, almost immediately after the Hearing started, because the JDCL application was made in 2012 under a GET zoning bylaw which had been repealed and replaced in 2016.
JDCL’s new application: Three months later, in December 2016, JDCL re-applied to GET and to Wellington County under the County’s new official plan and Township’s new zoning bylaw.
JDCL’s new appeal to the OMB: By the end of June 2017, JDCL once again appealed to the OMB based on ‘non-decisions’ by both County and Township when a minimum regulation deadlines (120 and 180 days respectively) had passed.
Now, with this first Pre-Hearing Conference date set the OMB is once more gearing up to hear the case. Last time round there were three pre-hearing conferences. We don’t know how many there will be this time, nor do we know when the Hearing itself will take place.
The November 2 Pre-Hearing Conference will last no more than a day, perhaps even just a few hours. As those who attended will remember, it will address:
identification of the Parties to the Hearing, of which CRC plans to be one;
identification of participants;
identification of issues;
possibility of settlement of any or all of the issues;

In October 2016 the original OMB Hearing into the James Dick Construction Limited application for an aggregate licence for the proposed Hidden Quarry and for re-zoning was postponed indefinitely when it became clear that the JDCL application was predicated on a Guelph Eramosa Township zoning bylaw which had been repealed and replaced since the original 2012 application. The OMB Co-Chair determined that he was not authorized to make a ruling under these circumstances. In December 2016 JDCL re-applied to GET for re-zoning, and to the County of Wellington for an Official Plan amendment. In the absence of decisions within the minimum Planning Act timelines, the company has once again appealed the case to the OMB.
